Terms of Service

These Terms of Service ("Terms") govern your access to and use of ContentOS, operated by Alevate Spaces Pvt Ltd ("we", "our", or "us"), including our website at contentos.social, web application, API, and browser extension (collectively, the "Service").

By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or 16 in the EU/EEA) to use ContentOS. If you are using the Service on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms.

2. Accounts

• You are responsible for keeping your login credentials confidential.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at support@contentos.social if you suspect unauthorised access.
• One person may not maintain more than one free account.

3. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Infringe the intellectual property rights of others
• Publish spam, unsolicited messages, or deceptive content
• Distribute malware, viruses, or any code intended to damage systems
• Scrape, crawl, or extract data from the Service without our written consent
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Use the Service to harass, abuse, or harm any person
• Circumvent rate limits, usage caps, or billing controls

We reserve the right to suspend or terminate accounts that violate these rules.

4. Your Content

You retain ownership of all content you create or upload to ContentOS ("Your Content"). By using the Service you grant us a limited, non-exclusive, royalty-free licence to store, process, and transmit Your Content solely to provide and improve the Service.

You represent and warrant that:

• You own or have the necessary rights to Your Content
• Your Content does not violate any third-party rights or applicable law
• You have obtained all necessary permissions to connect and post to your social media accounts

We do not use Your Content to train AI models. We do not sell Your Content to third parties.

5. Third-Party Platforms

ContentOS connects to third-party social media platforms (Instagram, Facebook, LinkedIn, X/Twitter, YouTube, etc.). Your use of those platforms is subject to their own terms and policies. We are not responsible for changes to third-party APIs that may affect the Service's functionality, including posting failures or account disconnections.

6. Subscription and Billing

• Paid plans are billed in advance on a monthly or annual cycle.
• All fees are non-refundable except where required by law or stated otherwise at purchase.
• We may change pricing with 30 days' notice. Continued use after the effective date constitutes acceptance.
• Failure to pay may result in suspension or downgrade of your account.
• Payments are processed by Stripe. By providing payment details you agree to Stripe's terms.

7. Free Plans and Trials

We may offer free plans or trial periods at our discretion. We reserve the right to modify or discontinue free tiers at any time with reasonable notice. Free plan data may be deleted after 90 days of inactivity.

8. Intellectual Property

ContentOS and all its components — including the software, design, logos, and documentation — are owned by Alevate Spaces Pvt Ltd and protected by applicable intellectual property laws. These Terms do not grant you any right to use our name, logo, or trademarks without prior written consent.

9. Termination

You may delete your account at any time from your account settings. We may suspend or terminate your access immediately if you breach these Terms, engage in fraudulent activity, or for other reasons at our reasonable discretion. Upon termination, your right to use the Service ceases. We will delete your data in accordance with our Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALEVATE SPACES PVT LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD 100.

12. Indemnification

You agree to indemnify and hold harmless Alevate Spaces Pvt Ltd and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your breach of these Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of India. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or a prominent notice in the app at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
